1. Acceptance — Implied Consent for Site Use

By accessing or using airtechpros.com, you acknowledge that you have read, understood, and agreed to these Terms and Conditions (“Terms”) and our Privacy Policy. Continued use of airtechpros.com — including browsing, scrolling, clicking, or submitting any form on the site — constitutes your acceptance of these Terms and the Privacy Policy as currently posted.

If you do not agree to these Terms or the Privacy Policy, do not use airtechpros.com.

For optional cookies, advertising, analytics, and similar technologies, please refer to your category-level controls in our cookie banner and the Cookie Preferences widget available on every page. For phone-call recording consent, the pre-call audio disclosure described in our Privacy Policy § 6 governs.

For form submissions that result in marketing communications (text messages, autodialed calls, or marketing emails), separate, specific opt-in consent is captured at the point of those forms where required by the Telephone Consumer Protection Act, FCC rules, the Telemarketing Sales Rule, and CAN-SPAM. Your acceptance of these Terms does not by itself constitute consent for marketing communications.

2. Description of Services and Scope of These Terms

Air Tech Pros provides residential and commercial heating, ventilation, and air conditioning services (the “Services”) to customers in Sacramento, Cameron Park, and all of Northern California, as stated within our Service Area page. airtechpros.com is the website through which prospective and existing customers may learn about the Services, request appointments, and communicate with us.

These Terms govern your use of airtechpros.com only. They do not govern the Services themselves: when you book an appointment, receive an estimate, sign a work-authorization form, or accept any other Air Tech Pros service contract, that separate agreement governs the Services delivered to you, including pricing, warranty, scope of work, payment terms, and any service-specific dispute-resolution mechanism. Where these Terms and a Services contract address the same subject, the Services contract controls with respect to the Services performed.

3. Use of the Website

You agree to use airtechpros.com only for lawful purposes and in a manner consistent with these Terms. You agree not to:

  • Interfere with the operation of airtechpros.com or the servers and networks that support it
  • Attempt to access areas of airtechpros.com that are not publicly available
  • Use automated means (scrapers, bots) to access airtechpros.com except as expressly permitted by our robots.txt or with our prior written consent
  • Misrepresent your identity or affiliation
  • Submit false, misleading, or infringing content

4. Intellectual Property

All content on airtechpros.com — including text, graphics, logos, images, video, software, and data — is owned by Air Tech Pros or its licensors and is protected by United States and international intellectual property laws. You may view and use the content for personal, non-commercial purposes. Any other use requires our prior written permission.

5. User-Submitted Content

Any content you submit to us through a form, email, phone call, or other channel — including service-inquiry descriptions, photographs, and comments — is licensed to us on a non-exclusive, royalty-free, worldwide basis for the purpose of delivering the Services you request and for our internal business purposes. You retain ownership of your content.

6. Electronic Communications

By submitting your email address or phone number through airtechpros.com, you consent to receive service-related communications from us regarding your inquiry, estimate, appointment, scheduled service, warranty, recall, safety, billing and invoicing for services delivered, customer support, and follow-up. These transactional or relationship communications are not marketing messages.

We send marketing emails only as permitted by applicable law. Marketing emails will identify the sender, avoid deceptive subject lines, include our valid physical postal address, and include a clear opt-out mechanism. We honor email marketing opt-outs within ten (10) business days as required by the CAN-SPAM Act (15 U.S.C. § 7704).

We send marketing texts, autodialed marketing calls, artificial-voice calls, or prerecorded marketing calls only where we have obtained any consent required by the Telephone Consumer Protection Act (“TCPA,” 47 U.S.C. § 227), FCC regulations, the Telemarketing Sales Rule (16 C.F.R. Part 310), and applicable state telemarketing laws. Where we obtain such consent, it is clear, conspicuous, captured separately from the implied site-use acceptance described in § 1, and not a condition of purchasing or receiving Services. We honor National and state Do Not Call list requirements as applicable.

You may revoke marketing consent at any time:

  • Reply STOP to a marketing text message (your wireless carrier may charge for the response message)
  • Reply HELP for assistance
  • Click the Unsubscribe link in any marketing email
  • Email privacy@airtechpros.com with “Unsubscribe” or “Revoke marketing consent” in the subject line

We will honor SMS opt-outs immediately upon processing of the STOP message.

7. Third-Party Services and Links

airtechpros.com may contain links to, or integrate with, third-party websites and services. We do not control and are not responsible for the content, privacy practices, or availability of those third parties. Your use of a third-party service is governed by that third party’s terms.

8. Disclaimer of Warranties

airtechpros.com and the content accessed through it are provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that airtechpros.com will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Limitation of Liability

To the maximum extent permitted by law, Air Tech Pros, its affiliates, and its service providers will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages — including lost profits, lost data, or business interruption — arising out of or in connection with your use of airtechpros.com, even if we have been advised of the possibility of such damages. Our aggregate liability for direct damages arising out of or in connection with your use of airtechpros.com will not exceed one hundred United States dollars ($100), or the amount you paid us (if any) for the access or service giving rise to the claim, whichever is greater.

10. Governing Law and Venue

These Terms are governed by the laws of the State of California without regard to its conflict-of-laws principles. Subject to § 11, any action that is not subject to arbitration shall be brought exclusively in the state or federal courts located in Sacramento County, California, and you consent to the personal jurisdiction of those courts.

Nothing in these Terms limits any non-waivable rights you may have under applicable consumer-protection, privacy, data-protection, or mandatory local law.

11. Dispute Resolution

11.1 Informal Negotiation

Before commencing any formal dispute resolution, the parties agree to attempt informal resolution for sixty (60) days following written notice of a dispute. Notice is to be sent to privacy@airtechpros.com or to our postal address.

11.2 Binding Arbitration

If informal resolution does not succeed within sixty days, and subject to the Exceptions in § 11.4, any dispute arising out of or in connection with these Terms or your use of airtechpros.com will be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. The arbitration will be conducted in English and, absent agreement otherwise, in Sacramento County, California.

Your right to opt out of arbitration. You may opt out of this arbitration agreement by sending us written notice, via email to privacy@airtechpros.com with subject line “Arbitration Opt-Out,” within thirty (30) days of your first use of airtechpros.com after these Terms take effect. Your opt-out notice must include your full name, postal address, and email address. Opting out does not affect any other provision of these Terms.

11.3 Class Action Waiver

To the extent permitted by law, arbitration under § 11.2 will be conducted on an individual basis only. You and we each waive any right to participate in a class, collective, consolidated, or representative action. If this Class Action Waiver is held unenforceable as to any particular claim, that claim will be severed and brought in court, and the remainder of § 11 will continue to apply to all other claims.

11.4 Exceptions

The following disputes are not subject to arbitration and may be brought in a court of competent jurisdiction:

  • Claims for injunctive or equitable relief relating to the enforcement or validity of a party’s intellectual property rights
  • Claims that may be brought in small-claims court, at your option
  • Claims that cannot by applicable law be subject to arbitration, including consumer claims that a consumer is entitled by statute to bring in court and which a pre-dispute arbitration clause cannot waive

11.5 Severability and Reformation

If any provision of § 11 is held unenforceable, it shall be severed and the remaining provisions shall continue in effect. If § 11.3 (Class Action Waiver) is held unenforceable as to an entire dispute, the parties agree that § 11.2 (Binding Arbitration) shall not apply to that dispute, and the dispute shall be resolved in the court specified in § 10.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on airtechpros.com and the Last Updated date at the top will be revised. Continued use of airtechpros.com after a material update constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, do not continue to use airtechpros.com.

13. Severability

If any provision of these Terms is held unenforceable, the remaining provisions will continue in full force.

14. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Air Tech Pros regarding your use of airtechpros.com and supersede all prior agreements and understandings, whether written or oral.
